### Riding Policy and Waiver for Track Days and Racing Events
#### 1. **Introduction**
All participants in track days and racing events organized by TrackTimeThailand do so at their own free will and must understand the inherent risks associated with high-speed motorcycle riding on a closed circuit. This policy sets out the terms under which participants agree to ride, as well as the waiver of liability for injuries, damages, and losses.
By signing this document or attending any event organized by TrackTimeThailand, the participant acknowledges and agrees to all terms listed below.
#### 2. **Assumption of Risk**
Motorcycle track riding and racing are inherently dangerous activities. By participating, each rider understands and accepts the risks involved, including, but not limited to:
– **Personal Injury:** Risk of serious injury or death.
– **Damage to Property:** Risk of damage to motorcycles or other personal belongings.
– **Risks to Others:** Risk of causing injury or damage to other riders or their motorcycles.
Each rider accepts full responsibility for their own safety and health while on the track. This includes proper use of protective gear, ensuring their motorcycle is in safe riding condition, and riding within their skill level.
#### 3. **Waiver of Liability**
By participating in a track day or racing event with TrackTimeThailand, each rider expressly agrees to waive any claims against the organizers, sponsors, venue, officials, volunteers, or other participants for injuries or damages sustained during the event. This includes, but is not limited to, the following:
– Any injury (fatal or otherwise) to the rider.
– Any damage to the rider’s motorcycle or personal property.
– Any damage or injury caused by or to other participants in the event.
– Any acts of negligence by any party involved in organizing or participating in the event.
#### 4. **Damage to Personal Property and Liability**
Each rider is fully responsible for any damage caused to their own motorcycle or other personal belongings, including in the event of a crash or mechanical failure. Riders are advised to inspect their motorcycles and gear thoroughly before each session on the track. Any repairs or replacements resulting from track incidents will be borne by the rider.
#### 5. **Rider Responsibility in Case of a Collision**
In the event of a collision between riders, the following rules apply:
– **Rider at Fault:** If a rider is determined to be at fault for a collision (e.g., reckless riding, poor decision-making, or ignoring track rules), they will be responsible for compensating the other rider(s) for any damage caused to their motorcycles or personal property.
– **Rider Error Causing a Crash:** If a rider’s actions (such as unsafe maneuvers or failure to follow track guidelines) lead to another rider’s crash, they will bear responsibility for the resulting damages to the affected rider’s motorcycle and any personal injury claims.
– **Assessment of Fault:** Fault determination will be made by event officials, who will review the incident and make a decision based on available evidence, including witness accounts and video footage if applicable.
#### 6. **Insurance**
Participants are advised to carry their own personal health, injury, and property insurance. It is the responsibility of each rider to verify whether their insurance policies provide coverage for track days and racing activities. TrackTimeThailand does not provide insurance for riders or their motorcycles.
#### 7. **Track Rules and Conduct**
All riders must adhere to the following rules while on the track:
– **Protective Gear:** All riders must wear proper protective gear, including helmets, gloves, riding suits, boots, and back protectors.
– **Motorcycle Condition:** Riders are responsible for ensuring that their motorcycles are in safe operating condition before each session.
– **Flag Signals:** Riders must obey all flag signals provided by the marshals. Failure to comply may result in exclusion from the event.
– **Overtaking:** Overtaking must be done safely and without endangering other riders. Aggressive or unsafe overtaking maneuvers will not be tolerated.
– **Pit Lane Etiquette:** Riders must respect pit lane speed limits and follow instructions from officials when entering or exiting the track.
– **No Alcohol or Drugs:** Riders must not consume alcohol or drugs before or during the event. Breathalyzer or drug tests may be conducted at random.
#### 8. **Waiver Acknowledgement**
By signing this waiver, each rider acknowledges that:
– They have read, understood, and agree to comply with this riding policy and waiver.
– They are voluntarily participating in the event and understand the risks involved.
– They agree to waive any claims against TrackTimeThailand, its officials, sponsors, or affiliates for any damages or injuries sustained.
– They accept full financial responsibility for any damages caused to their own motorcycle or property, as well as to any other rider or their motorcycle in case they are found at fault in an incident.
